Terms of Service

1. The service

Brand My Bag operates a paid public auction for six physical advertising positions on one backpack. A visitor may submit a brand, pay a bid through Stripe Checkout, and compete for a 30-day placement without creating a public account.

By submitting a bid or using a private management link, you agree to these Terms and confirm that you are authorized to act for the submitted brand.

2. Submissions and payment

You must provide an accurate brand name, work email, website, bid amount, and a PNG, JPEG, or WebP logo no larger than 2 MB. The minimum initial bid is USD 5.00. Stripe processes the payment on its hosted checkout page; Brand My Bag does not receive or store complete card numbers.

A form submission is not a paid bid. A bid joins the leaderboard only after a valid Stripe payment is confirmed by a signed webhook and recorded by Brand My Bag. A failed, declined, cancelled, or expired checkout does not increase a brand's total.

3. Ranking and placements

A brand's total is the sum of its successful auction payments less refunds. Ranking is determined by total paid amount from highest to lowest. If totals are equal, the brand that reached that total first ranks higher; remaining ties use brand creation time and a stable identifier.

Only the top six eligible brands appear on the backpack. Other paid brands remain visible on the leaderboard. When the auction is finalized, the top six receive 30-day placements. A later valid refund or fraud reversal may remove a placement and promote the next eligible brand for the remaining period.

4. Increasing a bid and private links

The private management link may be used to request a higher cumulative total. Stripe charges only the difference between the current paid total and the new total. The link is a credential: keep it private and contact us promptly if it is disclosed. We may rotate a compromised link.

5. Auction timing and refunds

New checkouts are accepted only while the persisted auction round is live. A payment completed or delivered after the applicable closing and webhook grace boundaries is ineligible and will be recorded and refunded. Duplicate payment events do not create duplicate bids.

Except for ineligible or reversed payments, bids buy immediate leaderboard exposure and are generally non-refundable. Any refund changes the paid total and may change ranking or placement. Stripe processing time and banking delays may affect when a refund appears.

6. Logo and brand licence

You retain ownership of submitted brand material. You grant Brand My Bag a worldwide, non-exclusive, royalty-free licence to host, resize, reproduce, and display that material on the website, leaderboard, backpack artwork, and reasonable documentation of the campaign for the auction and placement period.

You represent that you have the rights needed for this licence. Do not submit illegal, deceptive, infringing, hateful, explicit, malicious, or technically harmful content. We may reject or remove such material and take appropriate action on the associated placement.

7. Availability and responsibility

We aim to keep ranking and payment processing accurate, but internet, payment, email, and hosting services may be delayed or unavailable. To the extent permitted by law, the service is provided as available and Brand My Bag is not liable for indirect, incidental, or consequential losses. Nothing in these Terms excludes rights or liabilities that cannot legally be excluded.

8. Changes and contact

We may update these Terms for future use of the service. The version displayed when a bid is submitted applies to that bid unless a change is required by law or needed to protect the service.
